1. Extension of Due Dates by Hon’ble Supreme Court Order - The Hon’ble Supreme Court taking into account the difficulty faced by citizens due to lockdown announced by the Central Government, extended the due dates for various judicial / quasi judicial proceedings to an indefinite period. Now GST Circular 153/13/2021-GST dated July 20th, 2021 has been issued to clarify that the extended time limit will be applicable only in cases where Taxpayer is required to file an appeal before various authorities. The Circular also clarifies that the extension of time will not apply for any other compliances under the GST law including the due date for filing the refund application. However, the said circular might be challenged in the supreme court since the intention of the Supreme court in issuing the order was due to issues faced due to Covid pandemic and accordingly, such relaxation may be extended for other compliances as well.
2. Karnataka Govt. extends Time for Completion of Assessment or Reassessment or Rectification, withdrawal of Appeal under Karasamadhana Scheme, which grants the waiver of 100% of arrears of penalty and interest payable.
3. CBIC has issued notification 30/2021 and 31/2021, which provides that the Registered Person whose aggregate turnover in FY 20-21 is upto Rs. 2cr are exempted from filing annual return for FY 20-21. Further registered person with turnover upto Rs. 5 cr are required to file only GSTR 9 (GSTR9C is not required) and for people having AATO above 5 crores, need to file GSTR9 along with self-certified GSTR 9C (The GST Audit by CA/CMA is no longer required).
4. On the Corporate law, various relaxation for compliance filing have been extended till August 31, 2021 including the Form CFSS, ROC forms for Companies and LLP due for filling during between 1st April 2021 to 31st July 202. The MCA has issued clarification stating spending of CSR funds for COVID-19 vaccination for persons other than the employer and their families is an eligible CSR Activity.
5. The CBDT has extended due dates for electronic filing of a few forms considering the difficulties reported by taxpayers and other stakeholders. The due date for furnishing of Equalisation Levy statement for the Financial Year 2020-21 is extended to 31st Aug 2021, relaxation in electronic filing of forms 15CA and 15CB till 15th Aug 2021.
6. The last date to file income tax return for the financial year 2020-21 has been extended to September 30, 2021 to provide relief to the taxpayers amid the second wave of the COVID pandemic. However if the tax payable is exceeding 1 lakh, then the assessee are still required to pay interest u/s 234A.
7. RBI has instructed that No bank shall open current accounts for customers who have availed credit facilities in the form of cash credit (CC) / overdraft (OD) from the banking system and all transactions shall be routed through the CC/OD account.
